 Four people or entities have announced they will appeal the long-awaited $3.4 billion settlement of Cobell v. Salazar, prompting head-shaking from a group representing Navajo allottees.
"I don't understand why these people didn't opt out of the case when they had the chance," said Ervin Chavez, president of Shi Shi Keyah, speaking of the appellants.

According to attorneys for Elouise Cobell, trying the appeals could postpone the distribution of the settlement for a year or more - an outcome Chavez says is simply not acceptable considering all the beneficiaries who have died waiting for the landmark case to slog its way through the court system for the last 15 years.

Cobell had asked the Department of Interior to account for its management of individual Indian money accounts over the last 100 years. So many documents were missing or inaccurate that the task was impossible, and the government settled with the 500,000 Native American account holders for $3.4 billion - the largest settlement with the feds in U.S. history.

But some account holders, particularly Kimberly Craven of Boulder, Colo., a member of the Sisseton Wahpeton Oyate, have voiced strong objection to the settlement. Read more here.

Apparently Miss craven doesn't have a clue, her interference alone will be enough for the historic class, who haven't seen a dime of this settlement to die from old age, then where is the Justice?
All I can see is a woman trying to get her 15 minutes of fame and while in the process hurt whats left of the original lawsuit filers. it's enough to make this grown man cry, she has looked down the road and thinks she can get us, we the people a better deal, well I say to that, Where were you 15 years ago when this all started?, your a johnny come lately and haven't looked far enough down the road to know who you are going to hurt in the long run, Bravo miss Craven, Bravo

Yes Ms Craven, and to who else wants to appeal, why didn't YOU just opt out & sue the DOI yourself? Why didn't YOU go to court the past 15 years & hire your own lawyers? Do you realize well will never know how much money we have actually lost as an individual land owner? We have lost 3 elders in the past 6 months who watched this case closely, waiting anxiously on a payment. Are you all thinking of the rest of us 500,000 individual land owners who might want a payment, ..yesterday?

I have watched Native Americans for years, being Native myself, sabatage one another, or sabatage good things that come our way. I heard that "give Native Americans some money and they will fight amongst themselves". Why are these groups sabataging something a Native woman fought for and accomplished a deal for the Natives whose input she was inspired by. Some appellants are saying there was no Native input, but it was Native input that inspired Eloise Cobell to start the lawsuit. I agree, that they should not jump on Cobell's shoulders but rather, begin their own lawsuit if they are so inclined.

Way to go Kim Craven. These people don't understand WHAT they're giving up by being a party to this National Scam. Anyone who has Trust land and WAS NOT properly notified, nor given any notice of this ridiculous gov scam, did NOT know they had an OPT-OUT date are NOW stuck in this screwing. The Historical Class will get their puney HUSH checks and then be broke again and then the gov is coming for their land. Fare market value? These days that means FREE! Justice is not $1,000.00! This settlement is robbing you of your rights! The only people listed here who are upset over not receiving their "get lost" money are people who don't stand to loose anything. This case WAS NOT published and packets were NOT sent out to EVERY Native, so in some cases an Appeal is the right thing to do and when won will benefit the ones who have already BEEN FINANCIALLY screwed over by the Government Agencies. Kims' Appeal has NOTHING to do with GREED! The trivial amount of money the settlement wants to give you to make you go away, is just peanuts, and this number doesn't matter. It doesn't matter if it's $1,000, or $5,000.00 you are being screwed over, maybe not you directly, but maybe your neighbor, or someone from another reservation.....it effects everybody. This is a US Government scam. You are being corraled and hog tied and held against your will, and because of a few bucks you're allowing them to do this to you and your family, past, present and future. For ANY Native who has timber, grazing or minerals on their property of any kind.....NEEDS TO APPEAL, so you can have your own day in court and recover what was taken from you and your family. Cobell and her Attorneys do not have the RIGHT to tell you, "you get this much $ and that's all, now get out of our way. You are owed NOTHING more and your RIGHTS are GONE forever!" It tells me that there's something very "Fishy" about a settlement where you HAVE TO OPT-OUT of, and there's a deadline for doing that, or you're stuck in the settlement whether you want to be or not. Any American, and especially a Native American like myself, should be able to do what he or she wants regarding something like this. Why is there a deadline put on a person's right to say NO in regards to a situation such as this? Why can't I say I don't want to be a part of the trust settlement side of this after I've become informed of the consequences. Let those who want to stay in,stay in, let those who don't want any part of it, out. Maybe there'll be more money for those un-greedy persons if those of us who want out are allowed out. How is it that we're being held into something we obviously don't want to be a part of? Whatever happened to my freedoms? is there a deadline for that, too? Every person who has TRUST Land needs to Appeal this ridiculous case! Everybody here is complaining over a $1,000.00 that you didn't have before this case was srtarted to scam every Native who has Trust Land. These land owners have been cheated out of fortunes by the government agencies and you all don't know how long they have been working on getting back what the gov took from them, and a few dollars from this case is another slap in the face from gov control. The attorneys' will retire and be on a perminant vacation and you will all be back to broke. I find it interesting the comments about being screwed, enjoy spending your $1000 and this is a scam. Hmmm if you felt that way now, why not 15 years ago. Why didn't you and Craven give input 15 years to Elouise so she could understand your direction and maybe things would be different now?? This case was no secret back then. Why tell others that they are sell outs and spend your money wisely? Why don't you go out there and show them what they can get so they aren't sell outs, screwed and show them that your solution isn't a scam. It's always easier to criticize someone that is trying to do the right thing and help those that don't have the means or know how to battle the government. Do you just continue to grip about others trying to make a difference and do nothing, like you’re doing now? Look at other ethnic groups and how far they have advanced and some native folks here just want to stir the pot and keep bickering with each other and solve nothing while the world passed you bye. This case wasn't going on in the 60's and if you stood back and looked at what this settlement really means, you wouldn't want to be part of it. This is taking away your rights to ever recover what was taken by the government who was suppose to be looking out for us. The people who have trust assests are no longer able to go after what has been taken from them. The Historical Class...even though we don't have trust land, we can't ever go after anything that was done wrong through our IIM, and we are going to get maybe 1800.00 so what! The one who said this is a national scam, I agree. We are being taken advantage of again and I will not sale my land when they try to buy that for nothing. The government has cheated us over and over and we are getting really taken this time. We should have had to vote as a Nation on this settlement before the government and Elouise put us in this group and took my, our rights away from us. I wanted to go to washington DC, but I couldn't afford to and I would have protested this settlement because I understand what they are doing to us. Those that think this is a good thing, you are wrong, just wait to see what happens next, maybe you will get the real picture of what this settlement is about. I was reading below about giving the money back to the attorneys and if you understood why you were put in this settlemenrt in the first place you would know why the attorneys want you in this case. They get paid by how many people are in the settlement and this is another reason they did not inform all Indians in the US. The Cobell attorneys need all of us to be party to this, so they get more money and Kim is saying this is not right. Why are the attorneys taking so much, (do you really think they need to be paid $99,000,000.00) to do this case. No way!!! Kim is standing up for everyone and is saying, "the government already screwed us out of our money from our IIM Accounts and rental agreements and grazing and timber payments and now what little we will get back, the attorneys want to take it from us, so when she wins, we will get more of the money back instead of the arttorneys getting 99,000,000.00 they will get 50,000,000.00 that's still plenty of money for the attorneys for 15 years of paper pushing. Who do you know that makes that kind of money? The attorneys are taking OUR settlement money, so be patient and you will end up with more of what is ours in the first place. Aren't you sick and tired of being pushed around by the government? Talk to the Elders who were pushed around and lied to and now we are being lied to again. This is an "all time FARCE! I don't even want their dirty money. My rights and my Ammendments that are being violated and thrashed by this case are worth more to me than $1800.00 They paid us off as cheaply as possible.

You are never going to make anyone happy 100 percent. Every large case that has been settled the Lawyers have always taken a big chuck. Whether that is right or wrong it up to the legal department and the judges that allow those decisions. I say to the ones that say this is a farce, take the case on individually and locate the funds for yourself. Then you'll see a entire different picture. It's not as easy as you make it appear to look. Put your money, knowledge where your mouth is and stop complaining. DO SOMETHING, stop riding on others coat tails! It's not about money, but principle and that was a big WIN for all of us. You can't take money with you to the end. We all leave with the same thing.

There is NO money to be won, or paid in an appeal, so Kim does NOT get paid anything! To the one who wrote that people should start their own case and see where they get. You don't understand this settlement! The government put us in this without asking each of us first, and they will not let anyone out, and not every native was notified about this case and for GOOD reason, because this way; you can NOT go after what the government took from these people. That's what this case is really about. The government needed to round us up and knowing how many had been cheated by the BIA , they needed to make sure that no one could sue for what they are owed, because this has gone on for the entire history of our nation, it becomes a great amount of money owed to the people who have timber, grazing, oil and minerals on their allotted land. You can bet your bottem dollar that this is the largest screwing of our people of all time. None of us know how many of our people are in their own lawsuits against the government for stealing from them and their families, but this Cobell case will take their RIGHT away to go after what was taken from them. The only people here that are complaining about waiting for their check are the ones who didn't get cheated by the BIA and other government affiliates. The ones who had a few cents ran through their IIM accounts over the years, are not loosing anything, or loosing their rights (AT THIS POINT IN TIME ANYWAY!) It's just free money, and you need to look at the list of charges and places this settlement money is going to, because the majority is NOT going to the people. It's going to the attorneys and alot of it is going back to the government. Do your research on your internet. The ones who allowed the money to be mismanaged are now getting paid a fortune from this case, which is being taken from our settlement. You are not understanding this case!!! Again, appeals do not pay any money! For those of you who have trust land that pays you rental, or royalty call an attorney and they will work with you and when you win your case they get paid, and if you don't win they don't get paid. Don't let them do this to you and your family! Call attorneys who have native law background and they will help you. You only have a short amount of time to do this. You can appeal! The call is free and tell them your story. Somebody is standing up for all of us and trying to make this more fair and legal, so until you clearly understand what this settlement REALLY means, you should stay off her porch. At least she is trying to help all of us and we are all sitting back just waiting for a check in the mail. It'll be gone the same day we cash it and back to broke and now all of our Rights are gone forever and then the government is going to push us to sell what land we have left for just pennies. When this day comes and sooner than later, you will sit back and realize how screwed we and our familys' just got, especially our elder's who have been the ones that had something on their property that they got taken on for all of these years. Hey everyone, after reading all of these comments I made some phone calls and Cravens attroney is doing this for free. He works pro bono and is against this case because class action lawsuits and especially this one. I have been trying to learn what this means to us, because of all the comments I have been reading here and there about this and what I'm getting is like in my friends case who has thousands of acres of grazing land that the government is renting, she has been only getting $40.00 every month for about 80 years for her family and she could have gotten hundreds and maybe thousands every year, so she is furious with this settelment. She said she has been fighting with her tribe for many years to get more money for her land and now she isn't going to be able to get anywhere when they send us our checks because she didn't know how to get out of this settelment and couldn't get any help from the trust 1800 number to get out and now she will never get paid the right amount for the use of her land. She is so mad. This is making me nervous about what is really going on here. We are being gullable and hearing only what we want to hear and because we want the money we are making mistakes.

I attended the funeral services for Elouise Cobell Saturday. I challenge anyone to come to my house and talk to me face to face about the appeals to the Cobell case. The stress of 16 years of litigation may easily have caused the death of this warrior, and the real story of the struggle to get this settlement is a very very incredible story. The anonymous postings by ignorant people serve no purpose, and the appeals will serve no purpose other than to put more money in the pockets of W. Clifton Holmes, appellant attorney with the firm of Dunlap, Grubb, and Weaver in Leesburg VA. Perhaps these appellants have personal or political motivations, but I challenge any of them to tell me what good will come of their appeal.

Hmmm Pro Bono

Sometimes lawyers may begin on cases pro bono, but receive payment for their services later. This may happen in cases involving large cash settlements. At the end of such a case, the judge may encourage the successful plaintiff to pay his or her lawyer

Lots of comments and opinions, to appeal or not to appeal. Lots of hurtful and hateful things have been said over this whole issue. If we put enough energy into whats best for Indian Country instead of fighting amongst each other we could all benefit.

Keep in mind we lost our land when we were defeated by the U.S. Government and were put on the reservations (Land held in Trust) that are still owned by the U.S. Goverment. We will never own any of this land, unless we can somehow get the U.S. Government to hand over the deeds to the tribal communites. Until then, we are at the mercy of the U.S. Government.

Regardless of the Cobell settlement outcome the U.S. Government still wins. We"ll spend our money and wait for the Government to throw us another bone.

That's the problem with native community is they are waiting for another bone to be thrown. I don't see other ethnic groups having as much trouble as the native community. But heck all they do is fight with each other. So what, Cobell won something and a historical mark at that. Focus your direction in other things you can do to help rather than fight with each out. Think outside the box, do research, focus on your vision and make a difference. Why beat a dirty rug over and over and over. Can't that energy be used better else where to help the native community. Stop whining over losing land, it's been 200 years and native communities still haven't done anything but fight each other. If you want to make a difference, have a plan, and solicit others to help you reach the goal your looking for. Be strong, be proud, but by gosh stop whining! It's same story over and over and no action.

I agree with the person above. Stop whinning over 1800 dollars, it's a slap in our faces and you all act like it's this huge win. It's another joke on us and like others say here, they threw us a bone and we're all blinded by a few dollars. So many of our people have been cheated by the US Government and they are not done cheating us yet, there was no justice for us in this case. The only ones who are winning are the governmenrt offices who didn't do their jobs on our behalf (like we and our elders before were promised,) lawyers and Cobells family. I'm sorry that she isn't with us anymore and I feel for her family, but we the people didn't win anything here and alot of our people will never get back what was taken from them, because of this case. We need to find away together to make the changes that our tribes need to have to be equal to all other ethnic backgrounds and we need to quit letting these people in these government offices dictate our lives and futures, because we are not being treated fairly and this case is going to bring more problems to our people and you can mark these words.

I think it is selfish of Kim Craven to hold up the cobell settlement. She may not be satisfied for her share of the settlement then why doesn't she opt out of the case and quit holding up the settlement for the rest of us actual class members who are satisfied with the decision. This may be the best that we can get. No one can opt out at this point the government wont let them. That should tell you something. WHY won't they let people OUT that WANT OUT???? (I know the answer, do you?) This is wrong and what they are doing to us is wrong. This was a set up from the beginning and not everyone was made aware of this case, especially the ones who were cheated the most by the government. They were avoided and not all were sent packets, so they didn't know they had to opt out, because they didn't even know the case was going on. There is a lot more to this case than most of you are aware of. You only know what the government wanted you to know. The Craven appeal was filed when it needed to be filed just as the other appeals were filed at the appropriate time. Each of us will benefit from the appeals when they"win" and they should win as this case is not "for" our people. It's again to benefit "the governmen" who has been cheating us and our friends and families all of these years. Craven is not greedy, nor trying to cause us grief, because we have to wait a little longer for the trivial pay off that the courts want to pay us to make us go away. Sure our friends and family members have passed during this case and didn't get their trivial pay off, but this 1800, or so is not going to make any (permanent changes) in our lives, I really don't think those who have passed were on their death beds saying, or worrying about the trivial 1800 dollars that they didn't get to spend at Walmart. More power to the ones who are standing up against this case and fighting for the rest of us who are sitting back waiting for a check and haven't lost a dollar because of government fraud. We don't know their true stories and what's happened to them and to their families. I know people who were stolen from and who were fighting for their rights to what was theirs and this settlement will not do them justice what so ever. Our rights are now gone, because of the settlement. Those of us who are just waiting for a check in the mail and who didn't loose anything over the years, do not have any thing to complain about. This settlement is not about us, it's about the people who have lost their fortunes, because the DOI wasn't doing their job and full filling their obligation to them based on the agreements the government made us subjects to and subjects to the government terms. We are being screwed over again and for those who don't see this, or don't understand the true meaning of what happened here you should be asking lawyers some questions and getting advise. i read all these and the last one says cravens has 900,000,so that tells me she doesn't need to appeal for a little more money. it's my understanding that she did this so everyone else could get more of the settlement money (the people the money is for in the first place) instead of the attorneys taking far more than they deserve, not to mention all the money from our settlement that is going back to the government to the secretary of the interior. i heard craven is fighting for all of us, so the ones who have already been cheated by the government will hopefully get a little more back then 1800. do you realize where all of the settlement money is actually going? it's not going to us the ones it's suppose to be for in the first place. so i don't see her as greedy at all. she has the means to help the rest of us and she at least is doing something that will benefit the people if she wins for all of us. you should be thanking her instead of slamming her! if she wins you will be happy to get more of your own settlement and then are you going to take the time to go on here and thank her, probably NOT!

Pro Bono til the end and then they get their payoff $$. The average person is not going to get much more than $1800, who we kidding. In my opinion this whole thing is ripping everybody and everyone of us off. This should have been left to the people who were ripped off by the government to go after on their own with their own lawyers. None of the rest of us who weren't ripped off should be getting any money from this in the first place. Everything I read on the websites is everyone throwing crap and they are all people who shouldn't be part of this anyway. We are lucky to be getting anything at all and the ones who this case is for are getting ripped off all over again and by the same government who ripped them off in the first place. If Craven wins her appeal and her lawyer gets some of the money at least it's not just going to Cobell's lawyers who are taking to much of the money in the first place, so might as well spread it around some more, cause the one's who were cheated are the one's really loosing and the rest of us are watching our mail boxes for free money. I think the money should go to the people that had their money taken in the first place. I know no one will agree with me, but that's o k, we each have our own way of thinking and our own set of ethics.

We are once again VICTIMS of our own government! Everyone that's involved in arranging and bringing on this settlement should be arrested for FRAUD. The government and the lawyers have DECEIVED us again and we each GAVE them permission to do so, by not opting out, so we could collect our mere $1800.00 dollars. At least that's what they say they are mailing us. We'll see the REAL dollar amount someday when the check gets here. We SOLD ourselves short again and sat back and did nothing while the government and lawyers made the rules and Violated our Rights once again. Hope $1800.00 (dollars) is worth our loss. ??????. It's something to think about and something that we'll have to explain to our younger generations. Why and what we gave up to get some (so called free) money. It's NOT so free, we gave up a lot for this amount of cash.

if you young guys would realize , the 1000 to 1800 is just a starting payment, some are getting more, if any of you bother to READ(google it) the fine print, after you are paid, you can opt out and not sell your fractionated land, but then again you knew that that, didn't you?

You need to re read the fine print! These settlement payments aren't anything even close to what people had stolen from them. All the people who are whining shouldn't have any money coming anyway. As far as opting out later goes you wait and see what's happening come land purchase time. There is so much more to this class action suit than you realize, or understand. You'll have a better understanding later. An eye opener. When it's to late! This is for the last comment on this page. Wait till you see the changes that are coming with in our own tribes. I'm not venting! I have a genuine concern for our people. I have friends who have been neglected and cheated by their own tribe and the government looked the other way and chose not to do the right thing and take care of the people who were being cheated. These people were put in these positions/government jobs to look out for our rights and they failed and this burden should not go un heard and be covered up, so the government can then screw over the rest of us. This Cobell Case is another cover up to keep the people quite and their idea on fixing this is to send all of us a few bucks. It's criminal! You obviously haven't lost anything, or personally know a family who has been ripped off, or your opinion of what they are doing to us would be more sympathetic. The people who don't understand what this settlement really means to all of us, all have your same opinion. All they care about is getting "their" free money. ( Believe me, it's not free!) I know it's hard times for everyone and we all need the money. I need it too, but my gut tells me this is bad money. The sooner this is over the better off we'll be. We can all put this section of this settlement behind us and then deal with the next set of corruption that's headed our way. The government won't be happy until they've gotten everything we have left. Wait and pay attention. God Bless Us All.

As a Native American I am embarrassed that we are squabbling over money that we will never see. History has proven that the U.S. Gov. never keeps its promises or treaty for that matter. Do you honestly think that you will ever see a dime from the gov? And what about the lands? Reality is the U.S. owns The land. By the time the case is settled the Gov. will be bankrupt and take that 3.4 billion and use it. As a Native American growing up on the reservation and being poor, I understand about poverty. The cycle of poverty will continue if we don't start educating ourselves. NO GOVERNMENT can take that away!!
