Ninth Circuit to Hear Arizona's SB 1070 'Transport' Provision

SAN FRANCISCO -- Lawyers for the state of Arizona today will defend one of the provisions of Arizona's controversial immigration law SB 1070 from a challenge by the American Civil Liberties Union and the U.S. Department of Justice. The provision, which makes it illegal to harbor or transport undocumented immigrants, was enjoined last September by a U.S. District Court judge in Phoenix. The decision was appealed to the Ninth Circuit Court of Appeals. Attorneys for the ACLU argue that the provision could criminalize those who work for religious or community-based organizations and those who give a ride to someone who doesn't have legal status.
